Deposits
I do not take deposits on puppies until they are, at least, two weeks old. I will NOT rehome a puppy until he/she is, at least, eight weeks old. There are no refunds on deposits, unless otherwise agreed upon in writing. If you have a deposit on a puppy, that puppy must be paid in full either in a lump sum, or through payments, by the time the puppy turns eight weeks old, otherwise your deposit is forfeited .The seller reserves the right to void this transaction and refund the deposit if the seller learns of any reason why the buyer might not be suitable for the puppy (example: buyer is found to be an animal abuser, violent person, representative of a pet store, representative of a research laboratory, owner of a puppy mill, ect...). If this contract is voided (as agreed upon by buyer and seller) or if through some tragic accident, the puppy were to die or otherwise become seriously injured before it goes to it's new home, then the deposit will be returned to the buyer; unless the buyer wishes to apply the deposit to another puppy, if one is available.
Use of the puppy
It is agreed between the breeder and the buyer that this puppy is being acquired as a family companion only, not for breeding or show stock. There will be NO reimbursement or compensation if you choose to breed this animal and it is not capable of reproduction. It is strongly suggested that you spay or neuter your pet. Buyer agrees that the puppy is not purchased for resale nor will it be used or trained for activities which are illegal or for which it is not suited by reason of temperment or conformation. Specifically, it will not be used as a guard or attack dog, or to hunt or fight other animals. The buyer agrees that he/she will not sell, transfer ownership or possession of the puppy to any person or organization whose intent is to resell (pet store), trade, or give away the puppy, or use in any experiment, laboratory, or use as breeding stock for a puppy mill.
Health
The breeder warrants that the puppy has had all first shots and to be in excellent health and free from parasites at the time of purchase/pick-up, but has not made and does not now make any further warranties as to the puppy's condition after pick-up. Any further veterinary care is rendered at the buyer's expense. It is the buyer's responsibility to prevent illness and injury by providing necessary booster vaccinations, veterinary care, nutrition, fresh water, and supervision. It is recommended by the breeder that the buyer takes the puppy to a veterinarian of his/her choice and recommends 7 (seven) days in which to do so. If, within those 7 (seven) days, a veterinarian finds the puppy to be unsound, unhealthy, or possessing a serious genetic defect, a statement in writing MUST be provided by that veterinarian documenting said conditions. Upon confirmation from breeders veterinarian of said condition, buyer may return the puppy and receive a full refund of the purchase price. Hernias do not apply. All precautions have been made to ensure that the puppy is in excellent health at the time of purchase, including vaccinations and dewormings. Puppies do not have full immunity until they are 16 weeks old. For their protection, please do not expose them to unknown areas or people until your veterinarian has completed their vaccination series. Puppies, especially toy breeds, are predisposed to developing hypoglycemia. Hypoglycemia is a condition that occurs when a puppy's blood sugar level falls below normal. Because hypoglycemia is NOT a disease, illness, or hereditary condition, but a condition which is completely preventable by the owner, it is not covered under this health guarantee. The breeder will NOT be held liable for any veterinary expenses related to hypoglycemia.
Ownership Responsibilities
The buyer agrees to maintain the puppy in a humane environment and properly train and care for the puppy. Specifically, the puppy should be properly licensed and inoculated against rabies, distemper, and parvovirus, and/or other communicable diseases as recommended by a qualified veterinarian. The puppy will not be allowed to roam and should be socialized and obedience trained appropriately. Breeder will NOT be responsible for any landlord, marital, housebreaking, behavioral problems, allergy problems, or problems with existing pets. There will be no refunds for these reasons or anything else of a personal nature.
Right of Recovery/Placement
In the event that the buyer in unable to keep the puppy/dog, or provide an appropriate home in accordance with this agreement, the puppy/dog will NOT be transferred to any persons or organizations other than the breeder unless agreed upon by the breeder. The buyer agrees to notify the breeder in the event any such contingency arises and will NOT abandon the puppy/dog to a shelter, nor sell, nor give the puppy/dog away. If the puppy/dog is found to have been sold or given away without the breeders knowledge and the breeder discovers this, the breeder WILL take legal action and original buyer of the puppy/dog will be responsible for all legal expenses incurred. The breeder wishes to ensure that this puppy/dog is ALWAYS in a place where he/she is properly cared for.
